Alina Habba has resigned as New Jersey's top federal prosecutor. This decision was prompted by a court battle that questioned her right to occupy the role.

Acceptance of Resignation

The head of the Justice Department, the Attorney General, accepted her stepping down on the start of the week. Bondi stated that the court's "flawed" ruling made it "untenable" for Habba to effectively run her office.

"Do not interpret following the order as giving up," she wrote. "This battle will now reach across America."

Judicial Challenge

The departure follows closely on a judicial panel determined that she had been serving in violation of the law as the top prosecutor. This decision is could influence scores of prosecutions in the Garden State.

The judicial panel ruled that a interim role that did not receive Senate approval breached the federal law governing appointments.

Bondi said that Habba will continue working within the justice department as a top consultant. Habba plans to challenge the decision of the ruling, in the hope of achieving a reversal.

Writing online, Bondi wrote that judges "must not second-guess the appointment of attorneys responsible for executing the executive branch's core responsibility of criminal prosecution."

Habba, 41, was initially recruited to the former president's legal defense in 2021. She went on to represented her client in his business records case in the previous year, leading to his conviction on 34 counts of document fraud.

Earlier, her appointment to the role of US Attorney, the former president had revealed he was appointing her as his presidential counsellor in a potential future term, describing her as "unwavering in her loyalty" and a dedicated fighter for justice.
